Surrogacy Director charged with defrauding a foreigner of Sh2.9 m


Family Fertility and Surrogacy Agency Limited director Winnie Warigia Maina,was charged before a Milimani Law with defrauding a foreigner of Sh2.9 million on the pretext that she would offer surrogacy services through her fertility centre.

According to Wikipedia, ‘Surrogacy is an arrangement, often supported by a legal agreement, whereby a woman (the surrogate mother) agrees to bear a child for another person or persons, who will become the child’s parent(s) after birth’.

People may seek a surrogacy arrangement when pregnancy is medically impossible, when pregnancy risks are too dangerous for the intended mother, or when a single man or a male couple wish to have a child. Surrogacy is considered one of many assisted reproductive technologies.

Jointly with others not arraigned before Courts senior principal magistrate Kennedy Cheruiyot on Thursday.she was accused of claiming she could get him a woman to carry his child.

She allegedly defrauded Dion William Van Aardt of Sh2,920,045 between January 12, 2018 and February 2, 2019 through her company.

Her lawyer George Kanyi applied for her release on bond after she denied the offence stating “she is a mother of four with the youngest being four months old.”

State prosecutor Kennedy Panyako did not oppose her bail application Mr Cheruiyot allowed the suspect’s bail plea then released her on a cash bail of Sh200,000. The case was set to be mentioned on March 26, 2020 for pretrial.

Kenya also equipped with well-qualified and experienced fertility doctors to help the infertile couples and there is no particular Surrogacy Law although both parties need to be between the age group of 23 to 40 years. Citizens from different countries can easily avail the facility of the egg donor and the surrogates here at less cost.
